Under the Real Estate Services Rules of the British Columbia Financial Services Authority (BCFSA), a REALTOR® must provide you with a formal Disclosure of Representation in Trading Services form at the earliest reasonable opportunity — before providing any real estate service.

This disclosure explains:

  • Whether the REALTOR® will be representing you as a client (with fiduciary duties: loyalty, avoid conflicts, full disclosure, confidentiality, use reasonable skill and care) — or whether the REALTOR® will only be providing services to you as an unrepresented consumer (no fiduciary duties, and any information you share can be used to benefit the other party in a transaction).
  • The name of the licensee and their brokerage.
  • Your right to seek independent legal advice.
